EU-registered funds held in Individual Savings Accounts (ISAs) and Child Trust Funds (CTFs) face the prospect of disqualification from these vehicles, unless they sign-up to the FCA’s Temporary Permissions Regime (TPR) by 30th October.
Luxembourg regulator issues Brexit reminders to UK investment firms

UK fund providers will have until 15th September 2019 to submit a ‘Brexit licence’ to the Luxembourg regulator to continue trading in the jurisdiction.
The European MiFID Template (EMT) has been used to transfer target market and costs and charges data from fund groups to distributors since January 2018. Having gone through a few iterations during development, the original version has not changed since it came into use over 18 months ago.
The Joint Committee of the three European regulators responsible for PRIIPs has just updated its Q&As and includes a detailed answer on how to arrive at the Recommended Holding Period (RHP) of a PRIIP.
The FCA has recently published the findings from its review of MiFID II costs and charges disclosure. The review covered 50 firms and found different interpretations of the rules.
Now in its 11th year, the FE Alpha Manager rating is now firmly established and highly coveted in the fund management industry. It deserves a muted round of applause for acknowledging the industry’s concerns and for publishing its Feedback Statement, FS19/1, responding to the huge number of responses it received to the CfI.

Increasingly, clients are demanding and expecting online tools and mobile functionality to be part of their online user experience along with a seamless customer experience.
While much attention since MiFID II came into force a year ago has been on cost disclosure, the European regulator ESMA has published two consultation papers (CPs) on integrating sustainability risks and factors in MiFID II, tightening up on suitability of advice, and in UCITS and AIFMD, incorporating them in product governance.

ESMA’s SMSG – its own panel of advisers, made up of industry participants, consumers and academics – has published its advice to ESMA on the proposals in the PRIIPs Consultation Paper, JC 2018 60, and it doesn’t pull any punches.
In the middle of the European Supervisory Authorities’ (ESAs) consultation on PRIIPs KIDs, there was cross-party agreement in the European Parliament’s Economic and Monetary Affairs Committee (ECON) that the target date for UCITS to publish PRIIPs KIDs should be extended by two years, from December 2019 to 2021.
One of the few positive things that can be said about PRIIPs KIDs is that, unlike UCITS KIIDs, they don’t all need to be updated during the same short window at the start of every year. So PRIIPs providers can stagger their workload throughout the year, carrying out their annual reviews after their funds’ accounting dates, possibly.
Lehman Brothers collapsed a decade ago. It was a key milestone in the global financial crisis, teaching investors a painful lesson that nothing is too big to fail. A lot has happened since then and anybody you ask will tell you it’s been a tough decade all round, both on political and economic fronts. In addition to the global financial crisis, the period also witnessed the European debt crisis which has had a significant knock on effect for the countries in Europe. Political events such as the Brexit referendum in 2016 led to further uncertainty in the region.
The European Supervisory Authorities (the ESAs, made up of ESMA, EBA and EIOPA), have published a series of letters between them and the European Commission (EC), over the proposed ending of the exemption for UCITS KIIDs at the end of 2019.
We spoke to Mikkel to get all the necessary information on the DCPT - from what it entails to how fund groups are going about populating the template.

The FCA has had a busy time so far in April, with the publication of, among other things, Policy Statement PS18/8 on final AMMS remedies, Consultation Paper CP18/9 on further proposed AMMS remedies and Occasional Paper 32 on the disclosure of fund charges.

Pre-sale Key Information Documents (KIDs) are now required for all Packaged Retail and Insurance-based Investment Products (PRIIPs) that don’t publish UCITS KIIDs. Following heavy criticism about misleading performance scenarios, the FCA says firms can now produce “explanatory materials to put the calculation in context”. Advisers can also “consider how to address this, for example by providing additional explanation as part of their communications with clients” without diminishing or contradicting the content of the KID.

There has been some debate about the effectiveness and use of fund ratings; with a 2016 Financial Conduct Authority (FCA) review suggesting that perhaps too much emphasis is placed on them. However, the latest Schroders Adviser Survey in December 2017 demonstrated their importance with just over 70% of advisers surveyed using ratings or a ratings agency[1] as part of their fund selection process. Another study by Platforum in 2017 [2] showed that research agencies influence £210bn of advised fund assets held on platforms, 52% of the total adviser platform market AUA. So why are they such an integral part of fund selection and how can asset managers use them to differentiate their funds?
Following the acquisition of GFR (Global Funds Registration) by FE earlier in 2017, we spoke to Martin Neason, Director at FE Global Funds Registration (GFR), to find out how he and his team work with their clients on a daily basis. We asked Martin about the challenges of cross-border funds’ registrations, Europe’s regulatory landscape , and the impact that Brexit may have on FE’s clients.

Now December is upon us, we are counting down to PRIIPs and MiFID II in days, rather than weeks or months.
Nine new questions are included in the latest version of the PRIIPs Q&As, published on 20 November, including a new section with a couple of questions on Multi-Option Products (MOPs).
As the name suggests, Absolute Return funds are meant to deliver positive returns in all market conditions. So, have they been meeting their objectives?
Having successfully delivered, after lengthy negotiations, the European MiFID Template (EMT) for the fund industry to provide the product data to populate customer reports under MiFID II, the European Working Group (EWG) has issued guidelines to help fund groups with the population of the EMT.
MiFID II and PRIIPs may have been “just around the corner” forever, but we are now in the last quarter before both come into force at the end of the year. And that three-month deadline may be creating a justified feeling of panic.
One of the biggest challenges a fund house faces in the modern day, apart from their investment strategy, is trying to ensure that their data is accurate, clean and reliable. Amongst others, challenges include meeting regulatory guidelines, reputation management and supporting the sales team.
It took just over six weeks for the European Supervisory Authorities (ESAs) to add 14 new questions to the 72 they answered in early July and they’ve supplemented this version with detailed flow charts of the decision process for the risk and reward calculations. With around four months to go, we expect the pace of updates either to speed up because answers are needed urgently or to dry up completely if everyone is confident they have everything they need. Does anyone believe there are no outstanding questions?
With MiFID II kicking off in January 2018, the European Working Group of asset managers and trade bodies has been putting in a huge effort to produce a standard template to deliver their target market and costs & charges data to distributors.
In February this year, the European Supervisory Authorities (ESAs) issued draft technical advice on EOS PRIIPs, along with a consultation paper (CP) on their proposals. On the back of responses to that CP, they have now submitted their Joint Technical Advice to the European Commission.

The latest version of the PRIIPs Regulatory Technical Standards (RTS) were published last month. You would think that, with the amount of thought and debate that have gone into PRIIPs since 2014, the RTS would cover every situation and to have a clear rule for each. But, sadly, that isn’t the case.

FE Managing Director Michael Holland writes open letter to ESA chairmen over proposed RTS changes

Michael Holland, Managing Director of FE, has today sent an open letter to the chairmen of the three European Supervisory Authorities (ESAs) and to several investment trade publications.
At least one prediction has been right today, as the European Commission’s Vice President Valdis Dombrovskis confirmed it has recommended a delay of 12 months to December 2017 for PRIIPs KIDs at its meeting on 9 November. This means that PRIIPs will go live at the same time as MiFID II, which was itself delayed by a year.
